NeighborCloud Terms and Conditions

By using NeighborCloud, you agree to the following Terms & Conditions. If you do not agree, please refrain from using this software. These Terms & Conditions outline the rules and regulations for homeowners using NeighborCloud, an HOA management software platform designed to streamline communication, payments, and management within your community.

1. Acceptance of Terms

2. Eligibility

  2. You are a homeowner, resident, or authorized user within a Homeowners Association (HOA) that has subscribed to the NeighborCloud service.

3. Scope of Service

NeighborCloud is a digital platform provided to facilitate communication, dues management, document sharing, and other HOA-related operations. While we provide tools for HOA management, NeighborCloud is not responsible for the governance, policies, or enforcement actions of your specific HOA.

4. User Responsibilities

As a user, you agree to:

  1. Provide Accurate Information: You must ensure that all personal and contact information provided during registration is accurate and up to date.
  2. Use the Platform Responsibly: You will not use NeighborCloud to upload, share, or distribute content that is unlawful, defamatory, abusive, obscene, or violates any applicable laws.
  3. Respect Other Users: You agree to communicate respectfully with HOA members, neighbors, and board members. Harassment or misuse of the platform may result in account suspension or termination.

5. Payments and Transactions

NeighborCloud may facilitate payment of HOA dues, assessments, or other fees as authorized by your HOA board. By using payment features, you agree to the following:

  1. Third-Party Processors: Payments are processed through third-party payment gateways. NeighborCloud does not store payment information.
  2. Service Fees: Certain transactions may include service fees, which will be disclosed before completing a transaction.
  3. Responsibility: NeighborCloud is not liable for disputes arising between homeowners and HOA boards regarding payments, fees, or refunds.

6. Privacy and Data Protection

Your use of NeighborCloud is governed by our Privacy Policy, which details how we collect, store, and protect your personal data. By using the Service, you consent to our data practices.

7. Intellectual Property

  1. Ownership: All software, features, designs, and content provided by NeighborCloud are the intellectual property of NeighborCloud, Inc. You may not copy, reproduce, distribute, or create derivative works without prior written consent.
  2. User Content: Any content uploaded or shared by users remains their property, but you grant NeighborCloud a non-exclusive, royalty-free license to host and display this content solely for Service operation.

8. Prohibited Activities

  1. Reverse-engineer, decompile, or attempt to extract the source code of the software.
  2. Upload viruses, malware, or any harmful code.
  3. Use the Service for any unauthorized or illegal purposes.

9. Disclaimer of Warranties

NeighborCloud provides its services “as is” and “as available.” We make no representations or warranties, expressed or implied, regarding the reliability, availability, or accuracy of the platform.

10. Limitation of Liability

NeighborCloud and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the Service. Our total liability, under any circumstance, shall not exceed the amount paid (if any) for accessing NeighborCloud in the prior 12 months.

11. Termination

NeighborCloud reserves the right to suspend or terminate your access if you violate these Terms & Conditions or engage in misuse of the platform.
